Supreme Court Ruling On Trump Tariffs Looms As Lawsuits Mount

The long-running legal fight over President Trump’s use of emergency powers to impose his so-called “Liberation Day” tariffs is approaching a decisive moment, though a final ruling is unlikely to bring closure.

A decision from the US Supreme Court is widely expected in the near term, possibly within days, yet the outcome could trigger a fresh wave of legal disputes.

Even before a ruling, litigation has accelerated. Since Thanksgiving, more than 100 companies, including major multinational retailers such as Costco, have sued the federal government, seeking refunds of import duties in the event the tariffs are invalidated. Those cases are poised to expand depending on how the Court rules.

The balance of opinion has increasingly turned against the former president’s position. Betting markets now assign roughly a 70% probability that the Supreme Court will affirm the judgments of two lower courts, both of which found that the administration exceeded its statutory authority when imposing the tariffs.

That shift appears to have influenced official rhetoric. Earlier warnings from Trump and senior officials emphasised dire economic and national security consequences if the tariffs were overturned. More recently, however, administration figures have hinted at contingency planning, including the exploration of alternative legal pathways to pursue similar trade objectives, suggesting an acknowledgement that the ruling may be unfavourable.

Complicating matters further, more than $100 billion in tariff revenue has already been collected. If the Court rules against Trump, disputes over whether – and how – that money should be returned could spark prolonged litigation, particularly amid reports that the funds are currently being rushed into the Treasury.

Taken together, unresolved refund questions, implications for trade agreements, and the prospect of new tariff strategies mean that an adverse ruling would leave behind a complex and costly aftermath.

The MultiFreight team is awaiting the court’s decision with great interest.
